Mowbreck Lane New Planning Application

To Discuss the New Wesham Housing Application
(Land East of Fleetwood Road: Fylde Borough Council Application 11/0763)

A new planning application for 100 homes at Wesham has been submitted.

The latest proposal for housing on the land to the east of Fleetwood Rd is on one of the fields previously rejected by the High Court. The field is of the same tenanted working arable farmland as the previous rejected application. Concern has been expressed that the new application is intended as a first phase which if successful would be followed by a further application to fully reinstate the previous scheme for 264 homes. The site layout shows the same spine road terminating at the field boundary.

Over a period of nearly 3 years the previous scheme was comprehensively rejected by the Council's planning committee, the government inspector, the Secretary of State, and finally on September 1st 2010 by the High Court.

Mowbreck Lane Planning Application APPEAL DISMISSED!

A housing developer’s appeal against the government’s decision to reject controversial plans to build 264 homes in Wesham has been dismissed. In 2008, Metacre Ltd, owned by one of Lancashire’s richest men Trevor Hemmings, who also owns Preston North End FC, submitted plans to build 264 affordable homes to the north of Mowbreck Lane. In November that year, residents launched a campaign against the plans which would have resulted in the loss of green belt land. The plans were unanimously refused by Fylde Council last year but the developer then appealed the decision and a planning enquiry was launched. Secretary of State Eric Pickles quashed the appeal but Metacre took the case to the High Court. His Honour Judge Sycamore, sitting as a deputy judge of the High Court, has now dismissed Metacre’s challenge to the Secretary of State. The judgement said: “Although it was recognised that there is a housing need (Eric Pickles) was not persuaded that such need outweighed or justified development in the countryside.” It added: “The correct approach was adopted. “I dismiss this statutory challenge.” CLICK HERE TO DOWNLOAD THE FINAL JUDGEMENT REPORT

MOWBRECK LANE APPEAL REFUSED !

After months of hard work by those opposed (it seems the whole of Wesham !) to the planning application by Metacre Ltd for the development of the land to the north of Mowbreck Lane for 264 houses,the Secretary of State has finally announced that the appeal has been REFUSED.

The Department for Communities and Local Government has notified the developer and interested parties, that the Secretary of State has considered the report from the Inspector, following the inquiry held between 14th and 22nd September 2010, that the original decision of refusal made by Fylde Borough Council would stand.

The developers still have the right to challenge the decision by making application within 6 weeks to the High Court.

Congratulations are in order to:-
  • Cllr Linda Nulty who delivered the original refusal proposition at Fylde Borough Council and at the inquiry
  • Medlar-with-Wesham Town Council for their original submission to FBC and at the inquiry
  • Wesham Action Group for their original submission to Fylde Borough Council and the detailed submission of their case at the inquiry
  • Many residents either through WAG or individually who made representations at the inquiry
